Refund policy
In the very rare occurrence that a customer wishes to return their cake or receive a refund, here are the conditions that apply.
Your Rights Under Australian Consumer Law
Your consumer rights are protected by your Consumer Rights under Australian Consumer Law. In the event that a product or service delivered by Cakebellies is affected by:
- a major problem that affects the problem (i.e. safety issue, very different from description or sample, or has an issue that would have stopped a customer from buying it had they known about it in advance).
- a minor problem (i.e. small design changes, an ingredient being unavailable)
- changes to the Cakebellies service,
You may be entitled to:
- a remedy
- a refund
- a replacement
Please note that not all entitlements apply to all scenarios as described by Australian Consumer Law.
Is the initial deposit refundable?
The initial deposit for your cake is only refundable in the rare event that Cakebellies needs to cancel your order. Outside of this, no deposits shall be refundable.
Does CakeBellies offer refunds?
A refund (minus the initial deposit) may be offered under the following circumstances:
- The cake contains allergens of which Cakebellies was expressly made aware by the Client before baking
- The cake is delivered late as a result of a delay by Cakebellies
- The cake is not finished by the due date as a result of a delay by Cakebellies
- Cakebellies has cancelled the Client's order, or has confirmed they will be unable to complete the Client's order
- The cake is significantly different from the approved or preferred style, and that difference has not been approved by the Client
- There is a food safety issue that puts the health of the recipient at risk.
Why would Cakebellies be unable to offer a refund?
Cakebellies does not offer refunds under the following circumstances:
- The Client changes the requirements too close to the due date, making Cakebellies unable to complete the order in time
- The cake has been mostly eaten or entirely finished when a refund is requested
- The cake contains allergens about which The Client did not inform Cakebellies
- The cake needs to be delivered to the venue, and that venue refuses to take delivery
- The cake has been set up incorrectly by the venue or by The Client
- The Client has damaged the cake due to incorrect handling
- The cake has spoiled from being left in inappropriate conditions (i.e. directly in the sun)
- The Client has moved the delivery address to a location outside Cakebellies' delivery area
- The Client has failed to pick the cake up on time
- The cake has been ordered as a present by a third party, and the recipient does not like the flavour or design (i.e. a parent purchases the cake for their child, but the child doesn't like the flavour or the design).
How long do I have to get a refund?
- Any requests for a refund must be made in writing within 24 hours of receiving the cake.
- Refunds can be requested by emailing cakebellies@gmail.com.
Do I have to return the cake to get a refund?
When a refund for a cake is requested, that cake must be returned to Cakebellies to ensure the complaint is valid. No refunds shall be processed in the event that the cake cannot be returned.
I didn't order the cake, but it was made for me. Can I request a refund?
Only the person who originally ordered and paid for the cake can request a refund.
Can I request a refund on behalf of the person who ordered it?
Only the person who originally ordered and paid for the cake can request a refund.
I've changed my mind about my order. Am I entitled to a refund?
If work has not started on producing your cake, you will be entitled to a refund minus your deposit and an administration fee that is equal to 20% of the total price of your cake.
If work has begun on your cake (i.e. ingredients and decorations have been purchased, cake is partially made), then you may be entitled to a partial refund minus the deposit, an administration fee equal to 20% of your total purchase price, plus any costs incurred by Cakebellies during the production of your cake.
How will my refund be processed?
In the event your refund is approved and your cake has been returned to Cakebellies, your refund will be processed through the same payment method used to purchase the cake.
